INVITATION TO BID
Separate sealed BIDS for 16th AVENUE NW DRAINAGE IMPROVEMENTS, CDBG FUNDS for City of Decatur will be received by the City of Decatur Purchasing Department, City Hall Tower, 3rd Floor, 402 Lee Street NE, Decatur, Alabama, until 2:00 P.M., WEDNESDAY, DECEMBER 2, 2009, and at that time, publicly opened and read aloud, City of Decatur Purchasing Department, Conference Room, City Hall Tower, 402 Lee Street, Decatur, Alabama. Bids must be submitted on proposal forms furnished by the City Engineer or copies thereof. Each envelope should be clearly marked 16th AVENUE NW DRAINAGE IMPROVEMENTS, INVITATION TO BID 09-042.
Under state law it is required that the bidder submit with his bid either a certified check, a cashier's check, or bid bond payable to the City of Decatur in an amount (subject to a maximum of $10,000.00) equal to five percent (5%) of the bid. In order for the bid to be considered, it must be accompanied by an acceptable bid bond or check.
A Performance Bond and Statutory Labor and Material Payment Bonds in the amount of 100% of the contract price will be required from the successful bidder at the signing of the contract. Liability insurance certificates shall be required of the successful bidder, and such certificates shall list "the City of Decatur, employees and agents" as additional named insured. No bid may be withdrawn after the scheduled closing time for the receipt of the bids for a period of ninety (90) days.
The City of Decatur will only accept bids submitted by contractors licensed as required by Title 34, Chapter 8, Section 1-26 inclusive, of the Code of Alabama of 1975, as amended. The prime contractor must submit a list of the names of all subcontractors and vendors within 48 hours after contract award.
Bid documents and drawings may be examined after November 16, 2009 at the Decatur Purchasing Department.
Qualification Requirements: Prior to opening bids and awarding the contract, bidders will be required to submit general qualification data and specific documentation of the following:
1. Bidder shall verify that all employees working on this project are legally entitled to do so.
2. Bidder shall verify full compliance with applicable requirements of the Davis- Bacon Act.
3. Evidence of a current General Contractor's License shall accompany bid.
4. Evidence of required insurance shall accompany bid.
This information will be a requirement in determining the selected vendor. Provided all of the bid requirements are met, the Owner will select the qualified contractor that is the lowest bidder for the award of the Construction Contract.
The right to reject any or all bids and to disregard any minor irregularities is reserved by the Owner.

COUNTY OF MORGAN
NOTICE is hereby given that a bill will be introduced at the 2010 Regular Session of the Legislature relating to providing protection areas for source water for public water systems in Morgan County and municipalities within Morgan County, and the prohibition of the construction and operation of facilities used for the storage and distribution of hazardous materials within certain proximities of source water. The substance of the bill will be as follows:
In Morgan County and municipalities located in the county, source water protection areas will be provided for public water supply systems. The construction and operation of a facility used for the storage and distribution of hazardous materials (storage facility) will be prohibited within certain proximities of source water. Legislative findings and declarations of policy will be provided relating to the health, safety, and welfare of Morgan County citizens regarding the safety of public water supply systems. Defined terms will be provided for the bill. A specific municipal process will be provided for applying for and issuing permits to potential future operators of a storage facility. Civil enforcement measures will be provided for violations of any provision of the act.
