Suit against HealthSouth not dismissed

MONTGOMERY (AP) — The Alabama Supreme Court has refused to dismiss a lawsuit that claims $1 billion in assets were fraudulently transferred to HealthSouth.

General Medicine, a Michigan company, is attempting to recover $376 million from the Birmingham health care giant in the lawsuit.

General Medicine claims it was a creditor of Horizon/CMS Healthcare Corp, a one-time subsidiary of HealthSouth, and Horizonís $1 billion in assets had been fraudulently transferred to HealthSouth.
