State appeals court upholds death penalty in Boaz slaying
MONTGOMERY (AP) — A state appeals court on Friday upheld the capital murder conviction and death sentence Rick Allen Belisle received for beating a clerk to death during a convenience story robbery in Boaz.
In a 5-0 decision, the Alabama Court of Criminal Appeals rejected Belisle's arguments that many errors occurred during his trial. The judges also ruled the death sentence "was the appropriate sentence in this case."
According to trial testimony, Belisle attacked clerk Joyce Moore with a metal pipe from a fan stand and a 6-pound can of peas. He allegedly beat her severely and left her to die.
