ATHENS — An Athens man is recovering from surgery after his girlfriend's father allegedly shot him in the arm and abdomen, a Limestone County investigator said.

The investigator, Lt. Brad Curnutt, said the victim, Devin Terry Byrd, 20, and his girlfriend, Alexandra Penny, were arguing Thursday night.

Curnutt said the couple lives in a pool house behind her father's home at 18211 Sewell Road.

Curnutt identified the father as Franklin Penny, 50.

"I don't know what the couple was arguing about, but when Mr. Penny heard it, he grabbed a shotgun and revolver and when out there," Curnutt said. Curnutt said Penny allegedly fired one warning shot into the air outside of the pool house.

"He then ordered Byrd off the property, but as Byrd was leaving, Penny shot him," Curnutt said.

The shot from the revolver hit Byrd's left arm and struck his abdomen.

Curnutt said MedFlight took Byrd to Huntsville Hospital.

Byrd underwent surgery Thursday and is in stable but serious condition, Curnutt said.

Penny is in jail charged with first-degree assault.

Bond was not set Friday.
