Scrushy files sealed request for new trial
MONTGOMERY (AP) — In a new move shielded from public view, attorneys for former HealthSouth CEO Richard Scrushy are seeking another trial because of new evidence and have asked the trial judge to step aside.
Scrushy's attorneys filed the request, along with 28 exhibits, Wednesday afternoon and got the court to seal it from public view. Court records said the request from Scrushy's attorneys for a new trial was based on "newly discovered evidence."
On Thursday, U.S. District Judge Mark Fuller gave prosecutors until Monday to respond to the request for his recusal and a new trial.
