Man charged in fatal wreck had DUI record

MONTGOMERY (AP) — The man charged with killing an off-duty Montgomery police officer in a wreck recently got out of jail after serving time for his third drunken driving conviction.

Micah Joel Day, 31, of Millbrook was arrested Monday on a reckless murder charge as he was discharged from a Montgomery hospital, said Martha Earnhardt, spokeswoman for the state Department of Public Safety.

She said the initial investigation points to alcohol being a factor in the wreck. Officer Robert Edward McCrory was killed in the wreck Friday night.
